Detailed information on this can be found in the following privacy policy.

2. General Notes and Mandatory Information

Data protection

The operators of this site take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with statutory data protection regulations as well as this privacy policy.
When you use this website, various personal data are collected. Personal data are data with which you can be personally identified. This privacy policy explains which data we collect and what we use them for. It also explains how and for what purpose this happens.
We point out that data transmission on the Internet (e.g. when communicating via email) can have security vulnerabilities. Complete protection of data from access by third parties is not possible.

Notice concerning the responsible party

The responsible party for data processing on this website is:

BE DIFFERENT LLC
Jörg Kopp
427 N. Tatnall Street
Wilmington, DE 19801
United States of America
Telephone: +1 302 319-9438
Email: info@be-different.org

The responsible party is the natural or legal person who, alone or jointly with others, decides on the purposes and means of processing personal data (e.g. names, email addresses, etc.).

Revocation of your consent to data processing

Many data processing operations are only possible with your express consent. You can revoke an already granted consent at any time. An informal email to us is sufficient for this purpose. The legality of the data processing carried out up to the revocation remains unaffected by the revocation.

Right to object to data collection in special cases and to direct marketing (Art. 21 GDPR)

If the data processing is based on Art. 6(1)(e) or (f) GDPR, you have the right at any time, for reasons arising from your particular situation, to object to the processing of your personal data; this also applies to profiling based on these provisions. The respective legal basis on which processing is based can be found in this privacy policy. If you object, we will no longer process your affected personal data unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights, and freedoms, or the processing serves the establishment, exercise, or defense of legal claims (Objection under Art. 21(1) GDPR).

If your personal data are processed for direct advertising purposes, you have the right to object at any time to processing of your personal data for the purpose of such advertising; this also applies to profiling to the extent that it is related to such direct advertising. If you object, your personal data will thereafter no longer be used for direct advertising purposes (Objection under Art. 21(2) GDPR).

Right to lodge a complaint with the competent supervisory authority

In the event of violations of the GDPR, data subjects have a right to lodge a complaint with a supervisory authority, in particular in the member state of their habitual residence, place of work, or the place of the alleged infringement. The right to complain exists without prejudice to any other administrative or judicial remedies.

Right to data portability

You have the right to have data which we process on the basis of your consent or in performance of a contract delivered to yourself or to a third party in a commonly used, machine-readable format. If you request the direct transfer of the data to another responsible party, this will only be carried out to the extent that it is technically feasible.

SSL or TLS encryption

This site uses SSL or TLS encryption for security reasons and to protect the transmission of confidential content, such as orders or inquiries that you send to us as the site operator. You can recognize an encrypted connection by the address line of the browser switching from "http://" to "https://" and by the lock icon in your browser’s address bar.

If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

Encrypted payment transactions on this website

If, after the conclusion of a fee-based contract, there is an obligation to provide us with your payment data (e.g. account number for direct debit authorization), this data will be required for payment processing.

Payment transactions via common payment methods (Visa/MasterCard, direct debit) are carried out exclusively via an encrypted SSL or TLS connection. You can recognize an encrypted connection by the address line of your browser changing from "http://" to "https://" and by the lock icon in your browser’s address bar.

With encrypted communication, any payment data you transmit to us cannot be read by third parties.

Information, blocking, deletion, and correction

Within the scope of the applicable legal provisions, you have the right at any time to free information about your stored personal data, their origin and recipient, and the purpose of data processing and, if applicable, a right to correction, blocking, or deletion of these data. For this purpose, as well as for further questions on the subject of personal data, you can contact us at any time at the address given in the imprint.

Right to restrict processing

You have the right to request the restriction of processing of your personal data. For this purpose, you can contact us at any time at the address given in the imprint. The right to restrict processing exists in the following cases:

  • If you dispute the accuracy of your personal data stored by us, we usually need time to verify this. For the duration of the verification, you have the right to request the restriction of processing of your personal data.
  • If the processing of your personal data was/is unlawful, you can request the restriction of data processing instead of deletion.
  • If we no longer need your personal data, but you need it to exercise, defend, or establish legal claims, you have the right to request the restriction of processing of your personal data instead of deletion.
  • If you have filed an objection under Art. 21(1) GDPR, a balance must be struck between your interests and ours. As long as it is not yet clear whose interests prevail, you have the right to request the restriction of processing of your personal data.

If you have restricted the processing of your personal data, such data—apart from being stored—may only be processed with your consent or for the establishment, exercise, or defense of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the European Union or a member state.

Objection to promotional emails

We hereby object to the use of contact data published within the framework of the imprint obligation for the sending of unsolicited advertising and information materials. The operators of the website expressly reserve the right to take legal action in the event of the unsolicited sending of advertising information, for example through spam emails.

3. Data Collection on Our Website

Cookies

Some of the internet pages use so-called cookies. Cookies do not harm your computer and do not contain viruses. Cookies serve to make our offer more user-friendly, effective, and secure. Cookies are small text files that are stored on your computer by your browser.

Most of the cookies we use are so-called “session cookies.” They are automatically deleted after the end of your visit. Other cookies remain stored on your end device until you delete them. These cookies enable us to recognize your browser on your next visit.

You can configure your browser so that you are informed about the setting of cookies and allow cookies only on a case-by-case basis, accept cookies for certain cases or generally exclude them, and activate the automatic deletion of cookies when closing the browser. If cookies are deactivated, the functionality of this website may be limited.

Cookies that are necessary to carry out the electronic communication process or to provide certain functions you desire (e.g. shopping cart functionality) are stored on the basis of Art. 6(1)(f) GDPR. The website operator has a legitimate interest in storing cookies for the technically error-free and optimized provision of its services. Insofar as other cookies (e.g. cookies for analyzing your surfing behavior) are stored, these are treated separately in this privacy policy.

Server log files

The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:

  • Browser type and browser version
  • Operating system used
  • Referrer URL
  • Host name of the accessing computer
  • Time of the server request
  • IP address

No merging of this data with other data sources is performed.

The collection of this data is based on Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the technically error-free presentation and optimization of its website – for this purpose, the server log files must be recorded.

Contact form

If you send us inquiries via the contact form, your details from the inquiry form, including the contact data you provide there, will be stored by us for the purpose of processing the inquiry and in case of follow-up questions. We do not pass on these data without your consent.

The processing of the data entered into the contact form is thus exclusively based on your consent (Art. 6(1)(a) GDPR). You can revoke this consent at any time by sending us an informal email. The legality of the data processing operations carried out up to the revocation remains unaffected by the revocation.

The data you have entered in the contact form will remain with us until you request us to delete it, revoke your consent to its storage, or the purpose for data storage no longer applies (e.g. after your request has been processed). Mandatory statutory provisions – in particular retention periods – remain unaffected.

Registration on this website

You can register on our website to make use of additional functions on the site. We use the data entered for this purpose only for the purpose of allowing you to use the respective offer or service for which you have registered. The mandatory information requested during registration must be provided in full. Otherwise, we will reject the registration.

For important changes, for instance in the scope of the offer or in case of technically necessary changes, we use the email address provided at registration to inform you in this way.

The processing of the data entered during registration is based on your consent (Art. 6(1)(a) GDPR). You can revoke any consent you have given at any time by sending us an informal email. The legality of the data processing already carried out remains unaffected by the revocation.

The data collected during registration will be stored by us as long as you are registered on our website and will subsequently be deleted. Statutory retention periods remain unaffected.

Processing of data (customer and contract data)

We collect, process, and use personal data only to the extent that they are necessary for establishing, defining the content of, or changing the legal relationship (inventory data). This is done on the basis of Art. 6(1)(b) GDPR, which permits the processing of data for the fulfillment of a contract or pre-contractual measures. Personal data about the use of our internet pages (usage data) are collected, processed, and used by us only to the extent necessary to enable the user to utilize the service or to bill the user.

The customer data collected will be deleted after completion of the order or termination of the business relationship. Statutory retention periods remain unaffected.

Data transfer upon contract conclusion for online shops, merchants, and goods dispatch

We only transfer personal data to third parties if this is necessary in the context of contract processing, for example to the company entrusted with the delivery of the goods or the credit institution tasked with handling the payment. No further transfer of the data occurs, or only if you have expressly consented to the transfer. Your data will not be passed on to third parties without explicit consent, for example for advertising purposes.

The basis for data processing is Art. 6(1)(b) GDPR, which permits the processing of data for the performance of a contract or pre-contractual measures.

Data transfer upon contract conclusion for services and digital content

We only transmit personal data to third parties if this is necessary in the context of contract processing, for example to the credit institution responsible for processing payments.

No further transfer of the data takes place, or only if you have expressly consented to such a transfer. Your data will not be passed on to third parties without your express consent, for example for advertising purposes.

The basis for data processing is Art. 6(1)(b) GDPR, which permits the processing of data for the performance of a contract or pre-contractual measures.

4. Social Media

Social media plugins with Shariff

Our pages use plugins from social media platforms (e.g. Facebook, Twitter, Google+, Instagram, Pinterest, XING, LinkedIn, Tumblr).

You can generally recognize these plugins by the respective social media logos. To ensure data privacy on our website, we use these plugins only in conjunction with the so-called “Shariff” solution. This application prevents the plugins embedded on our website from transmitting data to the respective provider as soon as you enter the page.

Only when you activate a plugin by clicking the corresponding button, a direct connection to the provider’s server is established (consent). As soon as you activate the plugin, the respective provider receives the information that you have visited our site with your IP address. If you are logged in to your respective social media account (e.g. Facebook) at that time, the provider can associate your visit to our pages with your user account.

Activating the plugin constitutes consent within the meaning of Art. 6(1)(a) GDPR. You can revoke this consent at any time with effect for the future.

5. Analysis Tools and Advertising

Google Analytics

This website uses functions of the web analytics service Google Analytics. The provider is Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

Google Analytics uses so-called “cookies.” These are text files that are stored on your computer and that allow an analysis of your use of the website. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there.

The storage of Google Analytics cookies and the use of this analysis tool are based on Art. 6(1)(f) GDPR. The website operator has a legitimate interest in analyzing user behavior in order to optimize both its web offering and its advertising.

IP anonymization

We have activated the IP anonymization function on this website. This causes your IP address to be truncated by Google within member states of the European Union or in other contracting states to the Agreement on the European Economic Area before transmission to the USA. Only in exceptional cases will the full IP address be sent to a Google server in the USA and truncated there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activities, and to provide further services related to website and internet usage to the website operator.
The IP address transmitted by your browser as part of Google Analytics will not be merged with other data from Google.

Browser plugin

You can prevent the storage of cookies by selecting the appropriate settings in your browser software; however, please note that in this case you may not be able to fully use all the functions of this website. You can additionally prevent the collection of the data generated by the cookie and related to your use of the website (including your IP address) by Google, as well as the processing of this data by Google, by downloading and installing the browser plugin available at the following link: https://tools.google.com/dlpage/gaoptout?hl=de†tools.google.com.

Objection to data collection

You can prevent the collection of your data by Google Analytics by clicking on the following link. An opt-out cookie will be set that prevents the collection of your data on future visits to this website: Google Analytics deaktivieren†crcyr-vuwk3zz-xqgs.worldsoft-wsw.com.

For more information on how Google Analytics handles user data, see Google’s privacy policy: https://support.google.com/analytics/answer/6004245?hl=de†support.google.com.

Contract data processing

We have concluded a contract data processing agreement with Google and fully implement the strict requirements of the German data protection authorities when using Google Analytics.

Google AdSense

This website uses Google AdSense, a service for integrating advertisements from Google Inc. (“Google”). Provider is Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

Google AdSense uses so-called “cookies,” text files that are stored on your computer and allow an analysis of the use of the website. Google AdSense also uses so-called web beacons (invisible graphics). Through these web beacons, information such as visitor traffic on these pages can be evaluated.

The information generated by cookies and web beacons about the use of this website (including your IP address) and the delivery of advertising formats is transmitted to a Google server in the USA and stored there. This information can be passed on by Google to its contractual partners. However, Google will not merge your IP address with other data stored by Google.

The storage of AdSense cookies is based on Art. 6(1)(f) GDPR. The website operator has a legitimate interest in analyzing user behavior in order to optimize both its web offering and its advertising.

You can prevent the installation of cookies by adjusting your browser software accordingly; however, please note that in this case you may not be able to use all the functions of this website to their full extent. By using this website, you consent to the processing of data collected about you by Google in the manner and for the purposes described above.

6. CRM (Worldsoft Business Suite) and Newsletter

This website uses the Worldsoft Business Suite (WBS). The provider is Worldsoft AG, Churerstrasse 158, 8808 Pfäffikon, Switzerland.

The Worldsoft Business Suite (WBS) is a CRM (Customer Relationship Management) system with which data can be organized and analyzed.

If you transmit your personal data to us via a web form or during an order, this data will be stored on the servers of Worldsoft AG in Switzerland. The EU Commission has certified that Switzerland has an adequate level of data protection comparable to EU law. Data transfer from the EU to Switzerland is permitted under data protection law. We have concluded a data processing contract with Worldsoft.

We will inform you of our privacy terms before you submit your data. By submitting the data, you consent to our collecting, processing, and using your personal data, within the framework of statutory regulations.

The purpose of use results from the context of the data transmission. Your data will be used for the purpose for which it was originally collected.

Example: If you order a product on our website, your data will be used to create and send the invoice and for any follow-up questions.

Legal basis

Data processing is carried out on the basis of your consent (Art. 6(1)(a) GDPR). You can revoke this consent at any time. The legality of the data processing operations already carried out remains unaffected by the revocation.

Data analysis by WBS

WBS enables us to categorize prospects and customers by means of various categories (so-called tagging). In this way, address entries can be categorized, for example, by gender, personal preferences (e.g. vegetarian or non-vegetarian), or customer relationship (e.g. customer or prospective customer).

Storage duration

The data you have stored with us will be kept until you revoke your consent.

After revocation of consent, your data will be deleted from both our servers and the servers of Worldsoft AG. For details, please refer to the data protection provisions of Worldsoft AG at: https://www.worldsoft.info/5765

Newsletter data

With the Worldsoft Business Suite (WBS), the sending of newsletters can be organized and analyzed. The data you enter for the purpose of subscribing to the newsletter will be stored on the servers of Worldsoft AG.

If you wish to receive the newsletter offered on the website, we require from you an email address or telephone number for SMS, as well as information that allows us to verify that you are the owner of the specified email address or telephone number and that you agree to receive the newsletter. Further data are not collected or are only collected on a voluntary basis. We use this data exclusively for sending the requested information and do not pass it on to third parties.

(The data you enter for the purpose of subscribing to the newsletter will be stored on the servers of Worldsoft AG.)

The processing of the data entered in the newsletter subscription form is exclusively based on your consent (Art. 6(1)(a) GDPR). The consent granted to store the data, the email address and the use thereof for sending the newsletter can be revoked at any time, for example via the "unsubscribe" link in the newsletter. The legality of the data processing operations already carried out remains unaffected by the revocation.

The data you have provided to us for the purpose of subscribing to the newsletter will be stored by us until you unsubscribe from the newsletter and deleted after you cancel your subscription. Data that we have stored for other purposes (e.g. email addresses for the members area) remain unaffected by this.

Data analysis by WBS

If we send newsletters with the help of WBS, we can determine whether a newsletter message was opened and which links were clicked, if any.

WBS also allows us to subdivide the newsletter recipients into different categories (so-called tagging). In doing so, newsletter recipients can be categorized, for example, by gender, personal preferences (e.g. vegetarian or non-vegetarian), or customer relationship (e.g. customer or prospective customer). This way, newsletters can be better tailored to the respective target groups. For more detailed information, please refer to: https://www.worldsoft.info/5243/wbs†www.bedifferent.worldsoft.info.

If you do not want an analysis by WBS, you must unsubscribe from the newsletter. For this purpose, we provide a corresponding link in every newsletter message.

Data that have been stored with us for other purposes (e.g. email addresses for the members area, address information for invoicing) remain unaffected by this.

7. Plugins and Tools

YouTube with enhanced privacy

Our website uses plugins from the site YouTube. The operator of the pages is YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA.

We use YouTube in enhanced privacy mode. According to YouTube, this mode ensures that YouTube does not store information about visitors on this website before they watch the video. However, the transfer of data to YouTube partners is not necessarily prevented by the enhanced privacy mode. Thus, YouTube connects to the Google DoubleClick network regardless of whether you watch a video or not.

Once you start a YouTube video on our website, a connection to YouTube’s servers is established. In the process, the YouTube server is informed which of our pages you have visited. If you are logged into your YouTube account, you enable YouTube to directly associate your browsing behavior with your personal profile. You can prevent this by logging out of your YouTube account.

Furthermore, after starting a video, YouTube may store various cookies on your device. With the help of these cookies, YouTube can obtain information about visitors to our website. This information is used, among other things, to compile video statistics, improve user-friendliness, and prevent fraud attempts. The cookies remain on your device until you delete them.

After starting a YouTube video, additional data processing operations may be triggered, over which we have no influence.

The use of YouTube is in the interest of an appealing presentation of our online offerings. This constitutes a legitimate interest within the meaning of Art. 6(1)(f) GDPR.

For more information on data protection at YouTube, please refer to their privacy policy at: https://www.youtube.com/t/privacy_at_youtube†www.youtube.com.

Vimeo

Our website uses plugins of the Vimeo video portal. The provider is Vimeo Inc., 555 West 18th Street, New York, New York 10011, USA.

When you visit one of our pages equipped with a Vimeo plugin, a connection to Vimeo’s servers is established. In the process, the Vimeo server is informed which of our pages you have visited. Vimeo also obtains your IP address. This applies even if you are not logged in to Vimeo or do not have a Vimeo account. The information collected by Vimeo is transmitted to the Vimeo server in the USA.

If you are logged into your Vimeo account, you enable Vimeo to directly associate your browsing behavior with your personal profile. You can prevent this by logging out of your Vimeo account.

The use of Vimeo is in the interest of an attractive presentation of our online offerings. This constitutes a legitimate interest within the meaning of Art. 6(1)(f) GDPR.

Further information on the handling of user data can be found in Vimeo’s privacy policy at: https://vimeo.com/privacy†vimeo.com.

Google Web Fonts

For uniform representation of fonts, this page uses so-called web fonts provided by Google. The Google Fonts are installed locally. No connection to Google servers is established in the process.

8. Our Social Media Presences

Data processing through social networks

We maintain publicly accessible profiles on social networks. The specific social networks we use can be found below.

Social networks like Facebook, Google+, etc. can usually analyze your user behavior extensively when you visit their website or a website with integrated social media content (e.g. Like buttons or advertising banners). When you visit our social media pages, numerous data processing operations are triggered. In detail:

If you are logged into your social media account and visit our social media presence, the operator of the social media portal can associate this visit with your user account. Your personal data may also be collected if you are not logged in or do not have an account with the respective social media portal. In this case, data collection may occur through cookies stored on your device or by recording your IP address.

Using the collected data, the operators of the social media portals can create user profiles in which your preferences and interests are stored. In this way, interest-based advertising can be displayed to you inside and outside the respective social media presence. If you have an account with the respective social network, interest-based advertising may be displayed on all devices on which you are or were logged in.

Please also note that we cannot track all processing on social media portals. Depending on the provider, additional processing operations may be carried out by the operators of the social media portals. For details, please refer to the terms of use and privacy policies of the respective social media portals.

Legal basis

Our social media appearances are intended to ensure the broadest possible presence on the internet. This is a legitimate interest within the meaning of Art. 6(1)(f) GDPR. The analysis processes initiated by the social networks may be based on differing legal grounds which must be indicated by the operators of the social networks (e.g. consent in the sense of Art. 6(1)(a) GDPR).

Controller and assertion of rights

When you visit one of our social media pages (e.g. Facebook), we, together with the operator of the social media platform, are responsible for the data processing operations triggered during that visit. You can assert your rights (access, rectification, deletion, restriction of processing, data portability, and complaint) both against us and against the operator of the respective social media portal (e.g. Facebook).

Please note that despite the joint responsibility with the social media portal operators, we do not have full control over the data processing operations of the social media portals. Our options are largely determined by the corporate policy of the respective provider.

Storage duration

The data that we directly collect from your visit to the social media presence will be deleted from our systems as soon as the purpose for its storage no longer applies, you request us to delete it, you revoke your consent to storage, or the purpose for storing the data no longer applies. Cookies remain on your end device until you delete them. Mandatory statutory provisions – in particular retention periods – remain unaffected.

We have no influence on the storage duration of data that the social network operators store for their own purposes. For details, please consult the privacy policies of the respective social networks (e.g. see their privacy policy links below).

Whenever Digistore24 components are integrated into our site, non-personal data are fetched from the Digistore24 server (e.g. a JavaScript file).

When this component is loaded, your web browser retrieves a webpage from the Digistore24 server. Our server has no influence on the extent to which your web browser transmits data to the Digistore24 server in this process. Our server itself does not transmit any data to Digistore24’s servers in this context.
